The Supreme Court declared the federal government’s intra-court appeal admissible in the case related to the proceedings in the Supreme Judicial Council against the retired judges.
In the Supreme Court, the case related to the proceedings in the Supreme Judicial Council against the retired judges was heard, a 5-member larger bench headed by Justice Aminuddin Khan heard the appeal of the federal government.
The court declared the federal government’s intra-court appeal admissible in the Aafia Sherbanu case.
The Supreme Court has decided to appoint a judicial assistant for assistance.
The Supreme Court asked the Attorney General for the names of the judicial assistants and legal questions today and adjourned the hearing of the case till February 19.
The Attorney General said that in 1989, the Supreme Court declared the appeal regarding the appointment of judges admissible even though it was overdue. The President sends a reference against a judge with the approval of the Cabinet. Neither the President nor the federal government was made a party in the Shahrabano case.
Justice Aminuddin Khan inquired that on the basis of which questions should the overdue appeal be declared admissible? On which the Attorney General said that it was determined by the decision that the Supreme Judicial Council cannot take action against the retired judge, according to the decision of Aafia Shahrbanu, the Supreme Court can issue instructions to the Supreme Judicial Council or regulate it.
The Attorney General further said that the Federal Government agrees with this part of the judgment that the Supreme Court cannot issue directions to the Supreme Judicial Council, the ongoing inquiry cannot be terminated merely on the ground that the judges retire or resign, the pensions of the judges. It is not a problem of public trust, transparency and accountability on the judiciary.
